Jej\u00edm prim\u00e1rn\u00edm c\u00edlem je<br \/>\np\u0159edch\u00e1zet nepravidelnostem v LT. <\/li>\n<li>LT podnik\u00e1 na z\u00e1klad\u011b absolutn\u00edho respektu k z\u00e1kon\u016fm, osv\u011bd\u010den\u00fdm postup\u016fm a nejvy\u0161\u0161\u00edm etick\u00fdm standard\u016fm.<\/li>\n<li>Prim\u00e1rn\u00edm c\u00edlem Postupu je vytvo\u0159en\u00ed syst\u00e9mu nahla\u0161ov\u00e1n\u00ed v LT vytvo\u0159en\u00edm bezpe\u010dn\u00fdch oznamovac\u00edch kan\u00e1l\u016f, kter\u00e9 zabr\u00e1n\u00ed jak\u00fdmkoli odvetn\u00fdm opat\u0159en\u00edm v\u016f\u010di oznamovateli. <\/li>\n<li>Postup definuje pravidla a postup pro oznamov\u00e1n\u00ed informac\u00ed o poru\u0161en\u00ed z\u00e1kona, v\u010detn\u011b informace o d\u016fvodn\u00e9m podez\u0159en\u00ed na existuj\u00edc\u00ed nebo potenci\u00e1ln\u00ed poru\u0161en\u00ed z\u00e1kona, ke kter\u00e9mu do\u0161lo nebo pravd\u011bpodobn\u011b dojde v LT, nebo informace o pokusu o utajen\u00ed takov\u00e9ho poru\u0161en\u00ed z\u00e1kona.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 2<\/strong><\/p>\n<p>Kdykoli se postup t\u00fdk\u00e1 t\u011bchto \u00fadaj\u016f:<br \/>\n1. Pr\u00e1vnickou osobou \u2013 se rozum\u00ed spole\u010dnost LT;<br \/>\n2. Nestrann\u00fd organiza\u010dn\u00ed \u00fatvar (d\u00e1le jen &#8220;BJO&#8221;) \u2013 nestrann\u00fd v\u00fdbor pov\u011b\u0159en\u00fd LT \u2013 organiza\u010dn\u00ed jednotka v r\u00e1mci organiza\u010dn\u00ed struktury Pr\u00e1vnick\u00e9 osoby, opr\u00e1vn\u011bn\u00e1 p\u0159ij\u00edmat ozn\u00e1men\u00ed, p\u0159ij\u00edmat n\u00e1vazn\u00e1 opat\u0159en\u00ed a zpracov\u00e1vat osobn\u00ed \u00fadaje z\u00edskan\u00e9 v souvislosti s intern\u00edm ozn\u00e1men\u00edm, v\u010detn\u011b ov\u011b\u0159en\u00ed ozn\u00e1men\u00ed, komunikace s oznamovatelem. BJO je Komise pro poru\u0161en\u00ed p\u0159edpis\u016f;<br \/>\n3. Postup \u2013 znamen\u00e1 Postup pro p\u0159ij\u00edm\u00e1n\u00ed intern\u00edch ozn\u00e1men\u00ed a p\u0159ij\u00edm\u00e1n\u00ed n\u00e1sledn\u00fdch opat\u0159en\u00ed;<br \/>\n4. Z\u00e1kon \u2013 z\u00e1kon ze dne 14. \u010dervna 2024 o ochran\u011b oznamovatel\u016f (Sb\u00edrka z\u00e1kon\u016f, polo\u017eka 928).<br \/>\n5. Oznamovatel \u2013 fyzick\u00e1 osoba, kter\u00e1 ozn\u00e1m\u00ed poru\u0161en\u00ed z\u00e1kona a neu\u010din\u00ed tak z d\u016fvodu vlastn\u00edho pr\u00e1vn\u00edho z\u00e1jmu, a to bez ohledu na sv\u00e9 postaven\u00ed, formu pracovn\u00edho pom\u011bru nebo spolupr\u00e1ce, a to jak p\u0159ed, tak i po ukon\u010den\u00ed pr\u00e1vn\u00edho vztahu se spole\u010dnost\u00ed LT (v\u010detn\u011b: zam\u011bstnance, b\u00fdval\u00e9ho zam\u011bstnance, osoby uch\u00e1zej\u00edc\u00ed se o zam\u011bstn\u00e1n\u00ed, osoby vykon\u00e1vaj\u00edc\u00ed pr\u00e1ci na jin\u00e9m z\u00e1klad\u011b, ne\u017e je pracovn\u011bpr\u00e1vn\u00ed vztah,  a to i na z\u00e1klad\u011b ob\u010danskopr\u00e1vn\u00ed smlouvy,<br \/>\npodnikatelem, akcion\u00e1\u0159em nebo spole\u010dn\u00edkem, \u010dlenem org\u00e1nu pr\u00e1vnick\u00e9 osoby, osobou vykon\u00e1vaj\u00edc\u00ed pr\u00e1ci pod dohledem a veden\u00edm dodavatele, subdodavatele nebo dodavatele, a to i na z\u00e1klad\u011b ob\u010danskopr\u00e1vn\u00ed smlouvy, st\u00e1\u017eistou, dobrovoln\u00edkem);<br \/>\n6. Ozn\u00e1men\u00ed \u2013 je informace o poru\u0161en\u00ed z\u00e1kona, u\u010din\u011bn\u00e1 prost\u0159ednictv\u00edm komunika\u010dn\u00edch kan\u00e1l\u016f k tomu ur\u010den\u00fdch;<br \/>\n7. Osoba, kter\u00e9 se ozn\u00e1men\u00ed t\u00fdk\u00e1 \u2013 znamen\u00e1 osobu uvedenou v ozn\u00e1men\u00ed jako osobu, kter\u00e1 se dopustila poru\u0161en\u00ed;<br \/>\n8. N\u00e1sledn\u00e1 \u017ealoba \u2013 znamen\u00e1 \u0159\u00edzen\u00ed veden\u00e9 v souvislosti s podanou \u017e\u00e1dost\u00ed;<br \/>\n9. Kan\u00e1l pro oznamov\u00e1n\u00ed \u2013 znamen\u00e1 technick\u00e1 a organiza\u010dn\u00ed \u0159e\u0161en\u00ed umo\u017e\u0148uj\u00edc\u00ed pod\u00e1v\u00e1n\u00ed zpr\u00e1v;<br \/>\n10. Odvetn\u00fdm opat\u0159en\u00edm se rozum\u00ed p\u0159\u00edm\u00e9 nebo nep\u0159\u00edm\u00e9 jedn\u00e1n\u00ed nebo opomenut\u00ed v pracovn\u00edm kontextu, kter\u00e9 je zp\u016fsobeno ozn\u00e1men\u00edm a kter\u00e9 poru\u0161uje nebo m\u016f\u017ee poru\u0161ovat pr\u00e1va oznamovatele nebo zp\u016fsobuje nebo m\u016f\u017ee zp\u016fsobit oznamovateli neopr\u00e1vn\u011bnou \u00fajmu, v\u010detn\u011b bezd\u016fvodn\u00e9ho zah\u00e1jen\u00ed \u0159\u00edzen\u00ed proti oznamovateli.<\/p>\n<p style=\"text-align: center;\"><strong>\u00a7 3<\/strong><\/p>\n<ol>\n<li>Postup a jeho ustanoven\u00ed se vztahuj\u00ed na n\u00e1sleduj\u00edc\u00ed skupiny osob<br \/>\nopr\u00e1vn\u011bn\u00fdch podat ozn\u00e1men\u00ed:<br \/>\n1) zam\u011bstnanci a spolupracovn\u00edci, jako\u017e i b\u00fdval\u00ed zam\u011bstnanci a spolupracovn\u00edci LT,2<br \/>\n) osoby jednaj\u00edc\u00ed jm\u00e9nem a na \u00fa\u010det LT,3<br \/>\n) jak\u00e9koli dal\u0161\u00ed osoby, kter\u00e9 jsou s LT jakkoli spojeny, zejm\u00e9na: osoby pom\u00e1haj\u00edc\u00ed p\u0159i oznamov\u00e1n\u00ed nesrovnalost\u00ed, u\u010dni, st\u00e1\u017eist\u00e9 nebo uchaze\u010di o zam\u011bstn\u00e1n\u00ed,  pokud z\u00edskali informace o nesrovnalostech v pr\u016fb\u011bhu v\u00fdb\u011brov\u00e9ho \u0159\u00edzen\u00ed nebo jin\u00fdch proces\u016f p\u0159edch\u00e1zej\u00edc\u00edch vzniku pracovn\u00edho pom\u011bru.<\/li>\n<li>Oznamovac\u00ed nesrovnalosti se mohou t\u00fdkat zejm\u00e9na:<br \/>\n1) subjekt\u016f souvisej\u00edc\u00edch s LT,2<br \/>\n) fyzick\u00e9 osoby opr\u00e1vn\u011bn\u00e9 zastupovat LT,3<br \/>\n) zam\u011bstnanc\u016f a spolupracovn\u00edk\u016f LT v souvislosti s v\u00fdkonem pr\u00e1ce pro LT,4<br \/>\n) subdodavatele nebo jin\u00e9ho podnikatele, kter\u00fd je fyzickou osobou, pokud jeho zak\u00e1zan\u00e9 jedn\u00e1n\u00ed souviselo s pln\u011bn\u00edm smlouvy uzav\u0159en\u00e9 s LT,<br \/>\n5) zam\u011bstnancem nebo spolupracovn\u00edkem nebo osobou opr\u00e1vn\u011bnou jednat v z\u00e1jmu nebo ve prosp\u011bch podnikatele, kter\u00fd nen\u00ed fyzickou osobou, pokud jeho jedn\u00e1n\u00ed souviselo s pln\u011bn\u00edm smlouvy uzav\u0159en\u00e9 t\u00edmto podnikatelem s LT.<\/li>\n<li>Nesrovnalostmi se rozum\u00ed informace, zejm\u00e9na informace, kter\u00e9 mohou<br \/>\nnazna\u010dovat:<br \/>\n 1) podez\u0159en\u00ed z p\u0159\u00edpravy, pokusu nebo sp\u00e1ch\u00e1n\u00ed zak\u00e1zan\u00e9ho jedn\u00e1n\u00ed ze strany subjekt\u016f uveden\u00fdch v odd\u00edle 2,2<br \/>\n) nespln\u011bn\u00ed povinnosti nebo zneu\u017eit\u00ed pr\u00e1v ze strany subjekt\u016f uveden\u00fdch v odd\u00edle 2,3) neproveden\u00ed n\u00e1le\u017eit\u00e9 p\u00e9\u010de vy\u017eadovan\u00e9 za dan\u00fdch okolnost\u00ed p\u0159i \u010dinnostech subjekt\u016f uveden\u00fdch v odd\u00edle 2,3<br \/>\n) neproveden\u00ed n\u00e1le\u017eit\u00e9 p\u00e9\u010de vy\u017eadovan\u00e9 za dan\u00fdch okolnost\u00ed v \u010dinnosti subjekt\u016f uveden\u00fdch v odd\u00edle 2,3)   2.4<br \/>\n) nesrovnalosti v organizaci \u010dinnosti LT, kter\u00e9 by mohly v\u00e9st ke sp\u00e1ch\u00e1n\u00ed zak\u00e1zan\u00e9ho jedn\u00e1n\u00ed nebo ke zp\u016fsoben\u00ed \u0161kody,5<br \/>\n) poru\u0161en\u00ed ustanoven\u00ed obecn\u011b z\u00e1vazn\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f, na jejich\u017e z\u00e1klad\u011b LT funguj\u00ed,6<br \/>\n) poru\u0161en\u00ed intern\u00edch postup\u016f a etick\u00fdch norem p\u0159ijat\u00fdch v LT.<\/li>\n<li>Poru\u0161en\u00ed z\u00e1kona je jedn\u00e1n\u00ed nebo opomenut\u00ed, kter\u00e9 je nez\u00e1konn\u00e9 nebo m\u00e1 za c\u00edl<br \/>\nobch\u00e1zen\u00ed z\u00e1kona, pokud jde o:<br \/>\n1) korupce;<br \/>\n2) ve\u0159ejn\u00e9 zak\u00e1zky;<br \/>\n3) finan\u010dn\u00ed slu\u017eby, produkty a trhy;<br \/>\n4) boj proti pran\u00ed \u0161pinav\u00fdch pen\u011bz a financov\u00e1n\u00ed terorismu;<br \/>\n(5) bezpe\u010dnost a shoda s produktem;<br \/>\n6) bezpe\u010dnost dopravy;<br \/>\n7) ochrana \u017eivotn\u00edho prost\u0159ed\u00ed;<br \/>\n8) radia\u010dn\u00ed ochrana a jadern\u00e1 bezpe\u010dnost;<br \/>\n9) bezpe\u010dnost potravin a krmiv;<br \/>\n10) zdrav\u00ed a dobr\u00e9 \u017eivotn\u00ed podm\u00ednky zv\u00ed\u0159at;<br \/>\n11) ve\u0159ejn\u00e9 zdrav\u00ed;<br \/>\n12) ochrana spot\u0159ebitele;<br \/>\n13) ochrana soukrom\u00ed a osobn\u00edch \u00fadaj\u016f;<br \/>\n14) bezpe\u010dnost s\u00edt\u00ed a ICT syst\u00e9m\u016f;<br \/>\n15) finan\u010dn\u00ed z\u00e1jmy St\u00e1tn\u00ed pokladny Polsk\u00e9 republiky, \u00fazemn\u00edch samospr\u00e1vn\u00fdch celk\u016f a Evropsk\u00e9 unie;<br \/>\n16) vnit\u0159n\u00ed trh Evropsk\u00e9 unie, v\u010detn\u011b ve\u0159ejnopr\u00e1vn\u00edch pravidel hospod\u00e1\u0159sk\u00e9 sout\u011b\u017ee a st\u00e1tn\u00ed podpory a zdan\u011bn\u00ed pr\u00e1vnick\u00fdch osob;<br \/>\n17) \u00dastavn\u00ed svobody a pr\u00e1va \u010dlov\u011bka a ob\u010dana \u2013 vyskytuj\u00edc\u00ed se ve vztaz\u00edch jednotlivce s org\u00e1ny ve\u0159ejn\u00e9 moci a nesouvisej\u00edc\u00ed s oblastmi uveden\u00fdmi v bodech 1-16.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 4<\/strong><\/p>\n<ol>\n<li>Osoba, kter\u00e1 vykon\u00e1v\u00e1 celkov\u00fd dohled nad p\u0159ij\u00edm\u00e1n\u00edm a posuzov\u00e1n\u00edm ozn\u00e1men\u00ed ze strany Obchodn\u00edho \u00fa\u0159adu a vede rejst\u0159\u00edk p\u0159estupk\u016f, je Z\u00e1stupce pro poru\u0161en\u00ed z\u00e1kona.<br \/>\nZ\u00e1stupce pro poru\u0161en\u00ed p\u0159edpis\u016f je jmenov\u00e1n p\u0159edstavenstvem LT.  <\/li>\n<li>BJO, odpov\u011bdn\u00fd za p\u0159ij\u00edm\u00e1n\u00ed a posuzov\u00e1n\u00ed ozn\u00e1men\u00ed a opr\u00e1vn\u011bn\u00fd p\u0159ij\u00edmat n\u00e1sledn\u00e1 opat\u0159en\u00ed a komunikovat s oznamovatelem, je v\u00fdbor pro poru\u0161en\u00ed p\u0159edpis\u016f, kter\u00fd se skl\u00e1d\u00e1 ze z\u00e1stupce pro poru\u0161en\u00ed p\u0159edpis\u016f a 2 \u010dlen\u016f jmenovan\u00fdch spr\u00e1vn\u00ed radou LT s jejich souhlasem z n\u00e1sleduj\u00edc\u00edch osob: nesp\u0159\u00edzn\u011bn\u00e9 a nep\u0159\u00edbuzn\u00e9, ne\u017eij\u00edc\u00ed ve stejn\u00e9 dom\u00e1cnosti, neudr\u017euj\u00edc\u00ed \u00fazk\u00e9 soukrom\u00e9 vztahy s p\u0159edstavenstvem. Poru\u0161en\u00ed je analyzov\u00e1no V\u00fdborem v samosoudci, kter\u00fd navrhne zplnomocn\u011bnec<br \/>\n.Zplnomocn\u011bnec \u017e\u00e1dosti neposuzuje, leda\u017ee by to bylo nezbytn\u00e9 z d\u016fvodu nedostatku \u010dlen\u016f Komise, kte\u0159\u00ed by mohli tuto anal\u00fdzu prov\u00e9st.   <\/li>\n<li>Osoby, kter\u00e9 z obsahu ozn\u00e1men\u00ed vypl\u00fdvaj\u00ed, \u017ee by mohly b\u00fdt jak\u00fdmkoli zp\u016fsobem negativn\u011b zapojeny do jedn\u00e1n\u00ed nebo opomenut\u00ed zakl\u00e1daj\u00edc\u00edho nesrovnalost, se nemohou anal\u00fdzy ozn\u00e1men\u00ed z\u00fa\u010dastnit.<\/li>\n<li>Pokud se ozn\u00e1men\u00ed o nesrovnalosti t\u00fdk\u00e1 z\u00e1stupce pro poru\u0161en\u00ed p\u0159edpis\u016f nebo \u010dlen\u016f v\u00fdboru pro poru\u0161en\u00ed p\u0159edpis\u016f.  v takov\u00e9m po\u010dtu, kter\u00fd znemo\u017e\u0148uje jedn\u00e1n\u00ed ve slo\u017een\u00ed alespo\u0148 jedn\u00e9 osoby, jmenuje spr\u00e1vn\u00ed rada LT dal\u0161\u00ed osoby odpov\u011bdn\u00e9 za toto ozn\u00e1men\u00ed.<\/li>\n<li>Komisa\u0159 pro poru\u0161en\u00ed p\u0159edpis\u016f a v\u00fdbor pro poru\u0161en\u00ed p\u0159edpis\u016f jsou povinni zachov\u00e1vat ml\u010denlivost o informac\u00edch a osobn\u00edch \u00fadaj\u00edch z\u00edskan\u00fdch v pr\u016fb\u011bhu p\u0159ij\u00edm\u00e1n\u00ed a ov\u011b\u0159ov\u00e1n\u00ed ozn\u00e1men\u00ed a p\u0159ij\u00edm\u00e1n\u00ed n\u00e1sledn\u00fdch opat\u0159en\u00ed, a to i po ukon\u010den\u00ed pracovn\u00edho pom\u011bru nebo jin\u00e9ho pr\u00e1vn\u00edho vztahu, v jeho\u017e r\u00e1mci tyto \u010dinnosti vykon\u00e1vali.  <\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 5<\/strong><\/p>\n<ol>\n<li>Oznamovatel m\u016f\u017ee pod\u00e1vat hl\u00e1\u0161en\u00ed prost\u0159ednictv\u00edm e-mailu zaslan\u00e9ho na adresu LT@leasingteam.pl<br \/>\npro poru\u0161en\u00ed zabezpe\u010den\u00ed.<\/li>\n<li>Podan\u00e9 ozn\u00e1men\u00ed by m\u011blo obsahovat jasn\u00e9 a \u00fapln\u00e9 vysv\u011btlen\u00ed p\u0159edm\u011btu ozn\u00e1men\u00ed a m\u011blo by obsahovat alespo\u0148 n\u00e1sleduj\u00edc\u00ed informace: datum a m\u00edsto poru\u0161en\u00ed z\u00e1kona nebo datum a m\u00edsto z\u00edsk\u00e1n\u00ed informace o poru\u0161en\u00ed z\u00e1kona, popis konkr\u00e9tn\u00ed situace nebo okolnost\u00ed zakl\u00e1daj\u00edc\u00edch mo\u017enost poru\u0161en\u00ed z\u00e1kona, ozna\u010den\u00ed subjektu, kter\u00e9ho se ozn\u00e1men\u00ed t\u00fdk\u00e1, ozna\u010den\u00ed mo\u017en\u00fdch sv\u011bdk\u016f poru\u0161en\u00ed z\u00e1kona, uveden\u00ed v\u0161ech d\u016fkaz\u016f a informac\u00ed,  kter\u00e9 m\u00e1 oznamovatel k dispozici a kter\u00e9 mohou b\u00fdt u\u017eite\u010dn\u00e9 v procesu vy\u0159izov\u00e1n\u00ed ozn\u00e1men\u00ed.<\/li>\n<li>Subjekt nerozpozn\u00e1 anonymn\u00ed hl\u00e1\u0161en\u00ed.<\/li>\n<li>V souladu se z\u00e1sadou dobr\u00e9 v\u00edry by ka\u017ed\u00e1 osoba opr\u00e1vn\u011bn\u00e1 u\u010dinit ozn\u00e1men\u00ed m\u011bla ozn\u00e1mit nesrovnalost, pokud na jej\u00ed stran\u011b existuj\u00ed opr\u00e1vn\u011bn\u00e9 d\u016fvody domn\u00edvat se, \u017ee poskytnut\u00e9 informace jsou pravdiv\u00e9.<\/li>\n<li>Je zak\u00e1z\u00e1no v\u011bdom\u011b pod\u00e1vat fale\u0161n\u00e1 ozn\u00e1men\u00ed.<\/li>\n<li>Bude-li zji\u0161t\u011bno, \u017ee ozn\u00e1men\u00ed v\u011bdom\u011b obsahuje nepravdu nebo zaml\u010duje pravdu, m\u016f\u017ee b\u00fdt osoba pod\u00e1vaj\u00edc\u00ed ozn\u00e1men\u00ed \u010din\u011bna odpov\u011bdnou za p\u0159\u00edkaz uveden\u00fd v ustanoven\u00edch z\u00e1kon\u00edku pr\u00e1ce a ve zvl\u00e1\u0161tn\u00edch p\u0159edpisech, v\u010detn\u011b prov\u00e1d\u011bc\u00edch p\u0159edpis\u016f platn\u00fdch v Subjektu. Takov\u00e9 jedn\u00e1n\u00ed m\u016f\u017ee b\u00fdt kvalifikov\u00e1no i jako z\u00e1va\u017en\u00e9 poru\u0161en\u00ed z\u00e1kladn\u00edch povinnost\u00ed zam\u011bstnance nebo osob vykon\u00e1vaj\u00edc\u00edch v\u00fdd\u011ble\u010dnou \u010dinnost na jin\u00e9m ne\u017e pr\u00e1vn\u00edm z\u00e1klad\u011b, a jako takov\u00e9 m\u016f\u017ee m\u00edt za n\u00e1sledek ukon\u010den\u00ed pracovn\u00ed smlouvy\/ob\u010danskopr\u00e1vn\u00ed smlouvy bez v\u00fdpov\u011bdn\u00ed doby. <\/li>\n<li>O ud\u011blen\u00ed statusu oznamovatele rozhoduje v\u00fdbor pro poru\u0161en\u00ed p\u0159edpis\u016f. <\/li>\n<li>Status oznamovatele m\u016f\u017ee z\u00edskat kter\u00fdkoli oznamovatel, pokud z po\u010d\u00e1te\u010dn\u00ed anal\u00fdzy ozn\u00e1men\u00ed nevypl\u00fdv\u00e1 d\u016fvod p\u0159edpokl\u00e1dat, \u017ee oznamovatel zjevn\u011b nejednal v dobr\u00e9 v\u00ed\u0159e (presumpce dobr\u00e9 v\u00edry).<\/li>\n<li>Pro ka\u017ed\u00e9 ozn\u00e1men\u00ed ur\u010d\u00ed BJO jednu osobu odpov\u011bdnou za komunikaci s oznamovatelem. Tato osoba potvrd\u00ed p\u0159ijet\u00ed \u017e\u00e1dosti do 7 dn\u016f ode dne jej\u00edho obdr\u017een\u00ed zasl\u00e1n\u00edm zpr\u00e1vy na e-mailovou adresu, ze kter\u00e9 byla \u017e\u00e1dost odesl\u00e1na. <\/li>\n<li>Pokud se v pr\u016fb\u011bhu vy\u0161et\u0159ov\u00e1n\u00ed uk\u00e1\u017ee, \u017ee oznamovatel, kter\u00e9mu byl d\u0159\u00edve<br \/>\nud\u011blen status oznamovatele, nejednal ve zl\u00e9 v\u00ed\u0159e, je zbaven ochrany<br \/>\nposkytovan\u00e9 oznamovateli.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 6<\/strong><\/p>\n<ol>\n<li>K kan\u00e1l\u016fm pro oznamov\u00e1n\u00ed poru\u0161en\u00ed m\u00e1 p\u0159\u00edstup pouze \u00fa\u0159edn\u00edk pro<br \/>\n poru\u0161en\u00ed p\u0159edpis\u016f a dal\u0161\u00ed \u010dlenov\u00e9 v\u00fdboru pro poru\u0161en\u00ed p\u0159edpis\u016f nebo jin\u00e9 osoby<br \/>\nodpov\u011bdn\u00e9 za ozn\u00e1men\u00ed. <\/li>\n<li>Po obdr\u017een\u00ed ozn\u00e1men\u00ed, nejpozd\u011bji do 7 dn\u016f od jeho obdr\u017een\u00ed, provede v\u00fdbor pro poru\u0161en\u00ed p\u0159edb\u011b\u017en\u00e9ho ov\u011b\u0159en\u00ed ozn\u00e1men\u00ed, tj. z hlediska skute\u010dn\u00e9 pravd\u011bpodobnosti, \u017ee poru\u0161en\u00ed je pravdiv\u00e9 (&#8220;po\u010d\u00e1te\u010dn\u00ed ov\u011b\u0159en\u00ed&#8221;). Pozitivn\u00ed po\u010d\u00e1te\u010dn\u00ed ov\u011b\u0159en\u00ed vede k potvrzen\u00ed v\u00fdborem pro poru\u0161en\u00ed p\u0159edpis\u016f, p\u0159ijet\u00ed zpr\u00e1vy a ud\u011blen\u00ed statusu oznamovatele.<br \/>\nPotvrzen\u00ed je provedeno na e-mailovou adresu, ze kter\u00e9 byla \u017e\u00e1dost odesl\u00e1na.    <\/li>\n<li>V\u00fdbor pro poru\u0161en\u00ed podle odstavce 2 v\u00fd\u0161e, tj. po po\u010d\u00e1te\u010dn\u00edm ov\u011b\u0159en\u00ed, m\u016f\u017ee rozhodnout o neproveden\u00ed vy\u0161et\u0159ov\u00e1n\u00ed, pokud je ozn\u00e1men\u00ed zjevn\u011b nepravdiv\u00e9 nebo nen\u00ed mo\u017en\u00e9 z\u00edskat od oznamovatele dal\u0161\u00ed informace nezbytn\u00e9 k ov\u011b\u0159en\u00ed ozn\u00e1men\u00ed.   <\/li>\n<li>V\u00fdbor pro poru\u0161en\u00ed povinnosti ozn\u00e1men\u00ed pro\u0161et\u0159\u00ed a bez<br \/>\nzbyte\u010dn\u00e9ho odkladu p\u0159ijme n\u00e1sledn\u00e1 opat\u0159en\u00ed. <\/li>\n<li>V od\u016fvodn\u011bn\u00fdch p\u0159\u00edpadech (v souladu s odstavci 2 a 3 v\u00fd\u0161e) zah\u00e1j\u00ed Komise pro poru\u0161en\u00ed \u0161et\u0159en\u00ed (d\u00e1le jen &#8220;vy\u0161et\u0159ov\u00e1n\u00ed&#8221;) a pot\u00e9 ve lh\u016ft\u011b nejv\u00fd\u0161e do 30 dn\u016f rozhodne o opodstatn\u011bnosti ozn\u00e1men\u00ed za p\u0159edpokladu, \u017ee vy\u0161et\u0159uj\u00edc\u00ed subjekt je schopen v t\u00e9to lh\u016ft\u011b shrom\u00e1\u017edit pot\u0159ebn\u00e9 dokumenty a d\u016fkazy. <\/li>\n<li>Ve zvl\u00e1\u0161t\u011b slo\u017eit\u00fdch p\u0159\u00edpadech m\u016f\u017ee b\u00fdt ozn\u00e1men\u00ed o nesrovnalostech posouzeno ve lh\u016ft\u011b nejv\u00fd\u0161e 90 dn\u016f ode dne zah\u00e1jen\u00ed vysv\u011btluj\u00edc\u00edho postupu.<\/li>\n<li>S v\u00fdhradou odd\u00edlu 2, pokud zpr\u00e1va umo\u017e\u0148uje n\u00e1sledn\u00e1 opat\u0159en\u00ed \u2013 v\u010detn\u011b zkr\u00e1cen\u00e9ho postupu vysv\u011btlen\u00ed, mus\u00ed b\u00fdt tato opat\u0159en\u00ed provedena neprodlen\u011b po obdr\u017een\u00ed zpr\u00e1vy. <\/li>\n<li>Do vysv\u011btluj\u00edc\u00edho postupu mohou b\u00fdt zapojeni specialist\u00e9 a nez\u00e1visl\u00ed konzultanti<br \/>\n, pokud je to od\u016fvodn\u011bno skute\u010dnostmi<br \/>\npopsan\u00fdmi ve zpr\u00e1v\u011b, nap\u0159. vypracov\u00e1n\u00edm stanoviska k p\u0159edm\u011btu zpr\u00e1vy, v\u010detn\u011b pr\u00e1vn\u00edho stanoviska. <\/li>\n<li>Informace o pl\u00e1novan\u00fdch nebo proveden\u00fdch n\u00e1sledn\u00fdch opat\u0159en\u00edch a d\u016fvodech t\u011bchto opat\u0159en\u00ed budou oznamovateli poskytnuty nejpozd\u011bji do 3 m\u011bs\u00edc\u016f od potvrzen\u00ed o p\u0159ijet\u00ed ozn\u00e1men\u00ed (pokud nebude potvrzen\u00ed o p\u0159ijet\u00ed ozn\u00e1men\u00ed poskytnuto, do 3 m\u011bs\u00edc\u016f od uplynut\u00ed 7 dn\u016f ode dne ozn\u00e1men\u00ed).<br \/>\nZp\u011btn\u00e1 vazba je zas\u00edl\u00e1na na e-mailovou adresu, ze kter\u00e9 byla zpr\u00e1va odesl\u00e1na.<\/li>\n<li>V\u00fdbor pro poru\u0161en\u00ed m\u016f\u017ee vyd\u00e1vat doporu\u010den\u00ed ohledn\u011b vhodn\u00fdch n\u00e1pravn\u00fdch nebo disciplin\u00e1rn\u00edch opat\u0159en\u00ed ve vztahu k osob\u011b, kter\u00e1 se dopustila poru\u0161en\u00ed z\u00e1kona, a doporu\u010den\u00ed zam\u011b\u0159en\u00e1 na odstran\u011bn\u00ed a prevenci stejn\u00fdch nebo podobn\u00fdch poru\u0161en\u00ed, kter\u00e1 jsou pops\u00e1na v ozn\u00e1men\u00ed, v budoucnu. <\/li>\n<li>V\u00fdbor pro poru\u0161en\u00ed vypracuje zpr\u00e1vu o zji\u0161t\u011bn\u00edch vy\u0161et\u0159ov\u00e1n\u00ed a p\u0159edlo\u017e\u00ed ji Komisi pro poru\u0161en\u00ed p\u0159edpis\u016f, pokud z\u00e1stupce nen\u00ed autorem zpr\u00e1vy jako osoba prov\u00e1d\u011bj\u00edc\u00ed vy\u0161et\u0159ov\u00e1n\u00ed.  <\/li>\n<li>Zpr\u00e1va o \u0161et\u0159en\u00ed obsahuje popis zji\u0161t\u011bn\u00fdch skute\u010dnost\u00ed, v\u010detn\u011b zji\u0161t\u011bn\u00fdch nesrovnalost\u00ed a jejich p\u0159\u00ed\u010din, rozsahu a \u00fa\u010dink\u016f, a osob odpov\u011bdn\u00fdch za n\u011b.<\/li>\n<li>Komise ke zpr\u00e1v\u011b o vy\u0161et\u0159ov\u00e1n\u00ed p\u0159ipojuje n\u00e1vrhy na dal\u0161\u00ed opat\u0159en\u00ed. V z\u00e1vislosti na zji\u0161t\u011bn\u00edch mohou tyto akce zahrnovat opat\u0159en\u00ed proti osob\u00e1m vinn\u00fdm z poru\u0161en\u00ed, opat\u0159en\u00ed k prevenci poru\u0161en\u00ed a pos\u00edlen\u00ed vnit\u0159n\u00edho kontroln\u00edho syst\u00e9mu v subjektu.  Mezi takov\u00e1 opat\u0159en\u00ed mohou pat\u0159\u00ed zejm\u00e9na:<br \/>\n1) ukon\u010den\u00ed \u0159\u00edzen\u00ed bez dal\u0161\u00edho (v p\u0159\u00edpad\u011b, \u017ee ozn\u00e1men\u00ed nen\u00ed potvrzeno);<br \/>\n2) veden\u00ed rozhovoru, upout\u00e1n\u00ed pozornosti zam\u011bstnance;<br \/>\n3) napomenut\u00ed zam\u011bstnance, zbaven\u00ed zam\u011bstnance o \u010dlenstv\u00ed apod.<br \/>\n4) zm\u011bny nebo rotace pozic;<br \/>\n5) zm\u011bny ve vnit\u0159n\u00edch postupech;<br \/>\n6) prov\u00e1d\u011bn\u00ed ob\u010danskopr\u00e1vn\u00edch \u017ealob, t\u00fdkaj\u00edc\u00edch se nap\u0159\u00edklad uzav\u0159en\u00fdch smluv, n\u00e1pravy \u0161kody, v\u00fdplaty n\u00e1hrady \u0161kody;<br \/>\n7) pod\u00e1n\u00ed n\u00e1vrhu na zah\u00e1jen\u00ed k\u00e1rn\u00e9ho \u0159\u00edzen\u00ed;<br \/>\n8) pod\u00e1n\u00ed ozn\u00e1men\u00ed o d\u016fvodn\u00e9m podez\u0159en\u00ed ze sp\u00e1ch\u00e1n\u00ed trestn\u00e9ho \u010dinu (v p\u0159\u00edpad\u011b shroma\u017e\u010fov\u00e1n\u00ed d\u016fkaz\u016f);<br \/>\n9) informov\u00e1n\u00ed p\u0159\u00edslu\u0161n\u00fdch slu\u017eeb (v p\u0159\u00edpad\u011b shroma\u017e\u010fov\u00e1n\u00ed nep\u0159\u00edm\u00fdch d\u016fkaz\u016f).<\/li>\n<li>Spr\u00e1vn\u00ed rada \u017dP ur\u010duje dal\u0161\u00ed opat\u0159en\u00ed a osoby odpov\u011bdn\u00e9 za jejich prov\u00e1d\u011bn\u00ed.<br \/>\nZmocn\u011bnec dohl\u00ed\u017e\u00ed na realizaci t\u011bchto aktivit a poskytuje pomoc osob\u00e1m odpov\u011bdn\u00fdm za n\u011b.<\/li>\n<li>Komise informuje oznamovatele o u\u010din\u011bn\u00fdch zji\u0161t\u011bn\u00edch a o schv\u00e1len\u00fdch opat\u0159en\u00edch neprodlen\u011b po schv\u00e1len\u00ed z\u00e1v\u011br\u016f Spr\u00e1vn\u00ed radou LT, nejpozd\u011bji do 30 dn\u016f po ukon\u010den\u00ed \u0160et\u0159en\u00ed.<\/li>\n<li>P\u0159ijat\u00e1 opat\u0159en\u00ed, schv\u00e1len\u00e1 opat\u0159en\u00ed a jejich realizace jsou zaznamen\u00e1ny v registru \u017e\u00e1dost\u00ed.<\/li>\n<li>Rejst\u0159\u00edk nesrovnalost\u00ed obsahuje zejm\u00e9na:<br \/>\n1) kontaktn\u00ed \u00fadaje oznamovatele,2<br \/>\n) ve\u0161ker\u00e9 podrobn\u00e9 informace o ozn\u00e1men\u00ed,3<br \/>\n) pr\u016fb\u011bh anal\u00fdzy a projedn\u00e1n\u00ed ozn\u00e1men\u00ed o poru\u0161en\u00ed p\u0159edpis\u016f,4<br \/>\n) osoby a org\u00e1ny zapojen\u00e9 do procesu anal\u00fdzy a posouzen\u00ed ozn\u00e1men\u00ed,5<br \/>\n) v\u0161echna rozhodnut\u00ed a p\u0159\u00edpadn\u00e1 eskalace.<\/li>\n<li>Rejst\u0159\u00edk ozn\u00e1men\u00ed je veden v souladu se z\u00e1sadami ml\u010denlivosti a osobn\u00ed \u00fadaje a dal\u0161\u00ed informace v rejst\u0159\u00edku ozn\u00e1men\u00ed jsou uchov\u00e1v\u00e1ny po dobu 3 let od konce kalend\u00e1\u0159n\u00edho roku, ve kter\u00e9m byly ukon\u010deny navazuj\u00edc\u00ed \u00fakony, nebo po ukon\u010den\u00ed \u0159\u00edzen\u00ed zah\u00e1jen\u00fdch t\u011bmito \u00fakony.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 7<\/strong><\/p>\n<ol>\n<li>Zav\u00e1d\u00ed se absolutn\u00ed z\u00e1kaz odvetn\u00fdch opat\u0159en\u00ed v\u016f\u010di oznamovateli, kter\u00fd ozn\u00e1men\u00ed u\u010dinil (intern\u00ed i extern\u00ed), jako\u017e i zve\u0159ejn\u011bn\u00ed \u2013 v souladu se z\u00e1konem.<\/li>\n<li>Jak\u00e9koli represivn\u00ed, diskrimina\u010dn\u00ed nebo jinak nespravedliv\u00e9 zach\u00e1zen\u00ed s oznamovatelem bude pova\u017eov\u00e1no za poru\u0161en\u00ed Postupu a m\u016f\u017ee m\u00edt za n\u00e1sledek disciplin\u00e1rn\u00ed odpov\u011bdnost nebo ukon\u010den\u00ed smlouvy mezi odvetn\u00fdm subjektem a spole\u010dnost\u00ed LT.<\/li>\n<li>Ve vztahu k oznamovateli je nep\u0159ijateln\u00e9 zejm\u00e9na: odm\u00edtnut\u00ed nav\u00e1zat pracovn\u00ed pom\u011br, ukon\u010den\u00ed nebo ukon\u010den\u00ed pracovn\u00edho pom\u011bru bez v\u00fdpov\u011bdn\u00ed doby pracovn\u00edho pom\u011bru, sn\u00ed\u017een\u00ed odm\u011bny za pr\u00e1ci, pozastaven\u00ed pov\u00fd\u0161en\u00ed nebo opomenut\u00ed v poskytov\u00e1n\u00ed jin\u00fdch pracovn\u00edch v\u00fdhod ne\u017e odm\u011bny, p\u0159eveden\u00ed zam\u011bstnance na ni\u017e\u0161\u00ed pozici, pozastaven\u00ed v\u00fdkonu zam\u011bstnaneck\u00fdch nebo \u00fa\u0159edn\u00edch povinnost\u00ed, p\u0159evod st\u00e1vaj\u00edc\u00edch povinnosti zam\u011bstnance, nep\u0159\u00edzniv\u00e1 zm\u011bna m\u00edsta v\u00fdkonu pr\u00e1ce nebo rozvr\u017een\u00ed pracovn\u00ed doby, negativn\u00ed hodnocen\u00ed pracovn\u00edho v\u00fdkonu nebo negativn\u00ed stanovisko k pr\u00e1ci, ulo\u017een\u00ed nebo uplatn\u011bn\u00ed disciplin\u00e1rn\u00edho opat\u0159en\u00ed, v\u010detn\u011b pen\u011b\u017eit\u00e9 sankce, nebo opat\u0159en\u00ed obdobn\u00e9 povahy, pozastaven\u00ed \u00fa\u010dasti nebo neza\u0159azen\u00ed do v\u00fdb\u011bru na \u0161kolen\u00ed ke zv\u00fd\u0161en\u00ed odborn\u00e9 kvalifikace, neopr\u00e1vn\u011bn\u00e9 p\u0159ihl\u00e1\u0161en\u00ed k l\u00e9ka\u0159sk\u00e9mu vy\u0161et\u0159en\u00ed, v\u010detn\u011b psychiatrick\u00e9ho vy\u0161et\u0159en\u00ed,  Pokud zvl\u00e1\u0161tn\u00ed pr\u00e1vn\u00ed p\u0159edpisy stanov\u00ed mo\u017enost odeslat zam\u011bstnance k takov\u00e9mu vy\u0161et\u0159en\u00ed, je t\u0159eba podat \u017ealobu, jej\u00edm\u017e c\u00edlem je zt\u00ed\u017eit nalezen\u00ed<br \/>\nZam\u011bstn\u00e1n\u00ed.<\/li>\n<li>Za nep\u0159\u00edzniv\u00e9 zach\u00e1zen\u00ed v d\u016fsledku ozn\u00e1men\u00ed se pova\u017euje rovn\u011b\u017e hrozba nebo pokus o uplatn\u011bn\u00ed opat\u0159en\u00ed uveden\u00e9ho v odstavci 3. <\/li>\n<li>Ochrana se nevztahuje na oznamovatele, kter\u00fd je z\u00e1rove\u0148 pachatelem\/spolupachatelem\/<br \/>\nspolupachatelem nesrovnalosti.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 8<\/strong><\/p>\n<ol>\n<li>Ml\u010denlivost m\u00e1 zaru\u010dit pocit bezpe\u010d\u00ed oznamovatele a minimalizovat riziko odvety nebo represe. Oznamovatel, kter\u00fd u\u010dinil ozn\u00e1men\u00ed a jeho\u017e osobn\u00ed \u00fadaje byly neopr\u00e1vn\u011bn\u011b zve\u0159ejn\u011bny, by m\u011bl neprodlen\u011b informovat spr\u00e1vn\u00ed radu LT nebo v\u00fdbor pro poru\u0161en\u00ed p\u0159edpis\u016f, kter\u00e9 jsou povinny p\u0159ijmout opat\u0159en\u00ed na ochranu oznamovatele.  <\/li>\n<li>Toto\u017enost oznamovatele, jako\u017e i ve\u0161ker\u00e9 informace umo\u017e\u0148uj\u00edc\u00ed jeho identifikaci, nebudou sd\u011bleny subjekt\u016fm, kter\u00fdch se ozn\u00e1men\u00ed t\u00fdk\u00e1, t\u0159et\u00edm osob\u00e1m ani jin\u00fdm zam\u011bstnanc\u016fm a spolupracovn\u00edk\u016fm subjektu. Zejm\u00e9na:<br \/>\n1) \u00fadaje oznamovatele nejsou zve\u0159ejn\u011bny v \u017e\u00e1dn\u00e9m z dokument\u016f souvisej\u00edc\u00edch s \u0159\u00edzen\u00edm;<br \/>\n2) \u00dadaje oznamovatele nejsou zve\u0159ejn\u011bny na \u017e\u00e1dost stran nebo \u00fa\u010dastn\u00edk\u016f \u0159\u00edzen\u00ed;<br \/>\n3) \u00dadaje oznamovatele nejsou zahrnuty do distribuce dokument\u016f souvisej\u00edc\u00edch s \u0159\u00edzen\u00edm;<br \/>\n4) Oznamovatel nen\u00ed sv\u011bdkem v \u0159\u00edzen\u00ed, kter\u00e9 bude zah\u00e1jeno na z\u00e1klad\u011b jeho ozn\u00e1men\u00ed, ani nen\u00ed \u00fa\u010dastn\u00edkem nebo \u00fa\u010dastn\u00edkem zah\u00e1jen\u00e9ho \u0159\u00edzen\u00ed.<br \/>\nToto\u017enost oznamovatele, jako\u017e i dal\u0161\u00ed informace umo\u017e\u0148uj\u00edc\u00ed jeho identifikaci, mohou b\u00fdt zve\u0159ejn\u011bny pouze v p\u0159\u00edpad\u011b, \u017ee je takov\u00e9 zve\u0159ejn\u011bn\u00ed nezbytnou a p\u0159im\u011b\u0159enou povinnost\u00ed podle obecn\u011b platn\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f v r\u00e1mci \u0159\u00edzen\u00ed veden\u00fdch st\u00e1tn\u00edmi org\u00e1ny (nap\u0159. soudy). <\/li>\n<li>Subjekt zpracov\u00e1v\u00e1 osobn\u00ed \u00fadaje v rozsahu nezbytn\u00e9m pro p\u0159ijet\u00ed ozn\u00e1men\u00ed a p\u0159ijet\u00ed n\u00e1sledn\u00fdch opat\u0159en\u00ed. Osobn\u00ed \u00fadaje, kter\u00e9 nejsou relevantn\u00ed pro vy\u0161et\u0159ov\u00e1n\u00ed ozn\u00e1men\u00ed, nejsou shroma\u017e\u010fov\u00e1ny a v p\u0159\u00edpad\u011b shroma\u017e\u010fov\u00e1n\u00ed jsou vymaz\u00e1ny. Tyto osobn\u00ed \u00fadaje budou vymaz\u00e1ny do 14 dn\u016f ode dne, kdy bude zji\u0161t\u011bno, \u017ee jsou irelevantn\u00ed.  <\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 9<\/strong><\/p>\n<ol>\n<li>V ka\u017ed\u00e9m p\u0159\u00edpad\u011b lze ozn\u00e1men\u00ed podat ve\u0159ejn\u00e9mu ochr\u00e1nci pr\u00e1v nebo org\u00e1nu ve\u0159ejn\u00e9 moci, ani\u017e by byl dodr\u017een postup stanoven\u00fd v postupu, zejm\u00e9na pokud:<br \/>\n1) neposkytne oznamovateli zp\u011btnou vazbu ve lh\u016ft\u011b stanoven\u00e9 v Postupu LT, nebo<br \/>\n2) oznamovatel m\u00e1 d\u016fvodn\u00e9 podez\u0159en\u00ed, \u017ee poru\u0161en\u00edm pr\u00e1vn\u00edch p\u0159edpis\u016f m\u016f\u017ee doj\u00edt k bezprost\u0159edn\u00edmu nebo zjevn\u00e9mu ohro\u017een\u00ed ve\u0159ejn\u00e9ho z\u00e1jmu, zejm\u00e9na k riziku nenapraviteln\u00e9 \u00fajmy, nebo<br \/>\n3) proveden\u00edm intern\u00edho ozn\u00e1men\u00ed se oznamovatel vystavuje odvetn\u00fdm opat\u0159en\u00edm, nebo<br \/>\n4) v p\u0159\u00edpad\u011b intern\u00edho ozn\u00e1men\u00ed existuje n\u00edzk\u00e1 pravd\u011bpodobnost, \u017ee spole\u010dnost LT \u00fa\u010dinn\u011b zamez\u00ed poru\u0161en\u00ed p\u0159edpis\u016f vzhledem ke zvl\u00e1\u0161tn\u00edm okolnostem p\u0159\u00edpadu, jako je mo\u017enost zatajen\u00ed nebo zni\u010den\u00ed d\u016fkaz\u016f nebo mo\u017enost tajn\u00e9 dohody mezi spole\u010dnost\u00ed LT a pachatelem poru\u0161en\u00ed nebo \u00fa\u010dast spole\u010dnosti LT na poru\u0161en\u00ed.<\/li>\n<li>Ozn\u00e1men\u00ed u\u010din\u011bn\u00e9 ve\u0159ejn\u00e9mu ochr\u00e1nci pr\u00e1v nebo org\u00e1nu ve\u0159ejn\u00e9 moci bez intern\u00edho ozn\u00e1men\u00ed nem\u00e1 za n\u00e1sledek zbaven\u00ed oznamovatele ochrany zaru\u010den\u00e9 ustanoven\u00edmi z\u00e1kona.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>\u00a7 10<\/strong><\/p>\n<p style=\"text-align: left;\">Postup nab\u00fdv\u00e1 \u00fa\u010dinnosti dne 25. z\u00e1\u0159\u00ed 2024.<\/p>\n\n    <\/div>\n\t\t\t\t\t\n\t\t\t\t<\/div>\n\t\t\t\n            \n        <\/div>\n    <\/div>\n<\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"sidebarmenu-template","meta":{"_acf_changed":false,"footnotes":""},"class_list":["post-18446","page","type-page","status-publish","hentry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.3.1 -
